1. Description of the Service

FogWalk is a real-world exploration and mapping game that allows users to uncover a virtual "Fog of War" over a global map by physically moving through the real world.

2. Safe Usage and Assumption of Risk

Real-world exploration carries inherent risks. By playing FogWalk, you agree that:

• You are solely responsible for your safety: You must remain aware of your surroundings, traffic, pedestrians, and obstacles while using the app.
• No Trespassing: You agree not to enter private property without permission, trespass, or access dangerous, restricted, or prohibited areas.
• Do Not Drive and Play: FogWalk includes a Safety Lockout Dashboard that disables the map UI when traveling at high speeds. You agree not to attempt to bypass this feature or interact with the app while driving or operating heavy machinery.
• Assumption of Risk: You assume all risks associated with using the app in the real world. To the maximum extent permitted by law, Rhine Pereira shall not be liable for any injury, property damage, death, or any other damages arising from your use of the app.

3. User Accounts

• To use certain features, such as cloud syncing, you must create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when creating an account.

4. Privacy and Data Security

• Interfere with or disrupt the operation of the app or its servers.

We reserve the right to suspend or terminate your account if we determine you have violated these Terms.

6. Intellectual Property

All intellectual property rights in the FogWalk application, including but not limited to its design, code, graphics, and text, are owned by Rhine Pereira or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for your personal, non-commercial use.

The app is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the app, including the accuracy of the location tracking or map data.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Rhine Pereira shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the app.

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date and posting the revised Terms within the app. Your continued use of the app after such changes constitutes your acceptance of the new Terms.
